Public Disclosure Statements

Each MLA is required by the Integrity Act to periodically file with the Clerk of the Legislative Assembly a public disclosure statement, in the prescribed form. The public disclosure statement, in general terms, is to disclose the assets, debts, business interests, sources of income, etc., of the MLA, his or her family and his or her private company.

The contents of the public disclosure statement to be filed are listed in detail in the Integrity Act (s. 5). There is also a detailed list of exemptions, i.e., information relating to certain assists, debts and sources of income that an MLA is not required to include in his or her public disclosure statement.

Each MLA is required to file a public disclosure statement within 90 days after his or her election, and then annually on a date set by the Integrity Commissioner. In between those filing dates, if there is a change that occurs that significantly alters the information that is required in the public disclosure statement, the MLA is required to file, with the Clerk, a supplementary public disclosure statement within 30 days of any such change.

An MLA, or member of the MLA’s family, is not permitted to accept any gift, personal benefit or compensation that is connected, even indirectly, to the performance of the MLA’s duties of office. There are certain exceptions. (see s.13 of the Integrity Act). With respect to those exceptions, i.e., gifts or personal benefits that the MLA is permitted to accept, the MLA is required, within 30 days of receipt of the gift or benefit, to file a disclosure statement, again in the form prescribed by the Integrity Commissioner, detailing the nature of the gift or benefit, its source, and the circumstances under which it was given to the MLA and accepted by him or her.

These requirements for public disclosure serve the objective of transparency and assist the MLA to carry out his or her public duties in a manner that will bear the closest public scrutiny.

All three types of public disclosure statements are filed in the Office of the Clerk of the Legislative Assembly. Copies of these statements are available for inspection from:
